Man eating garnish jailed for shoving waitress at downtown Miami café: police

A Texas man is behind bars after police say he shoved a waitress to the ground at the Hard Rock Cafe in downtown Miami on Sunday. Investigators said the assault happened after the waitress told the man, who had wandered into an employees-only area, that he could not eat the garnishes meant for drinks prepared at the bar.

Police say 47-year-old Daniel Ramirez took off before they got there and members of his family who stayed refused to speak. Detectives say they were able to identify him after an anonymous tip came in days later, according to Ramirez’s arrest affidavit.

The woman who was allegedly assaulted told police that she told Ramirez he could not eat the garnishes, and he responded, “B—- what do you want me to do, spit it out?,” his arrest paperworks reads.

After they had both left the bar area, police say, the waitress was called over by her manager because Ramirez had made a complaint about her.

“The defendant told the manager that no woman was allowed to tell him what to do and that the victim needed to be reprimanded,” police wrote in Ramirez’s arrest affidavit.

At round 6:30 p.m., the waitress entered the Bayside Marketplace café through the front entrance to talk to a coworker when Ramirez roughly shoved her to the ground, causing her to hit a metal rack and chip her tooth, police say.

The woman saw Ramirez running out of the café, and followed him out while using a phone to take pictures of him. When Ramirez noticed he was being photographed, he struck the cellphone out of her hand and pushed in her face, making her fall to the ground once again, police say.

Ramirez yelled at her with his fists balled up as she stood up, police say. The woman said she later lost consciousness.

A video of the assault was uploaded to the popular social media page “Only in Dade,” prior to Ramirez’s arrest. Police circulated images of Ramirez. Investigators identified him after a tip came in, and the waitress identified him in a photo lineup on Thursday.

On Friday, Ramirez was detained by United States Customs and Border Protection at a Royal Caribbean Cruise terminal and handed over to Miami Police.

Jail records show that Ramirez is locked up at the Turner Guilford Knight Correctional Center and has a bond status of “to be set.” He’s charged with felony battery.
