A retired South Florida attorney tried to get genital photos from a minor

After sending a 16-year-old girl a picture of his penis via a messenger app, a retired Boca Raton attorney tried to get the girl to respond in kind. When the FBI arrived at his house with a search warrant, the former lawyer learned he’d been trying to talk an undercover FBI agent into sending child sex abuse material.

That’s in the admission of facts with Darryl Kogan’s guilty plea in Fort Lauderdale federal court to one count of attempted receipt of visual depictions involving the sexual exploitation of a minor. Kogen, 68, is scheduled to be sentenced Jan. 5.

Kogan was admitted to the Florida Bar in 1983. His online Florida Bar profile says he’s “permanently retired.”

What follows comes from Kogan’s admission of facts with his guilty plea.

The undercover FBI agent, acting on a tip, began “communicating with Darryl Kogan as a purported 16-year-old female, via the Kik Messenger application” on Feb. 18.

Kogan sent the undercover agent a penis pic, then “continued to communicate with the (the undercover agent) regarding sending sexually explicit images through the Kik application. Specifically, Kogan texted, ‘Need pics to start the process.’”

The undercover agent feigned trouble sending CSAM pics of herself through Kik. Kogan’s solution: the agent take a picture “not using Kik” of her genitals, adding instructions “so I know it is current.”

One search warrant got the FBI the numerous Kik accounts that Kogan was using “to engage in sexually explicit communications about minors.” Another one got the FBI into Kogan’s Boca Raton home.

“During the interview, Kogan confirmed the email addresses he used to establish the various Kik accounts as well as the associated telephone number with the accounts,” his admission of facts said. “Kogan explained to law enforcement that he would delete Kik accounts and set up new ones.”
