A couple from Sweden is suing the owners of a Miami Beach resort for $15 million, claiming the facility provided \u201cgrossly inadequate security.\u201d The lawsuit follows an alleged attack on their 11-year-old daughter at the resort pool in October 2025.<\/p>\n

The family, including the parents and their three daughters, ages 19, 14, and 11, was vacationing in South Florida for the first time, spending a week at the Radisson Resort Miami Beach on 43rd Street and Collins Avenue<\/p>\n

<\/p>\n

According to a police report filed by the family, the attack occurred two days into their trip. Miami Beach police said that a 68-year-old man attacked the 11-year-old girl in the resort pool. The man was not a hotel guest and allegedly sneaked around the hotel\u2019s key card security system. Once in the pool, the man grabbed and groped the girl, police said.<\/p>\n

Investigators noted that the girl\u2019s family was on the pool deck when the attack happened. The girl was able to get away and immediately told her sisters and parents.<\/p>\n

<\/p>\n

The girl\u2019s father called the police and followed the man, who left the property by going through a neighboring hotel. Officers arrested a suspect, identified as Osvaldo Diaz, on Collins Avenue.<\/p>\n

<\/p>\n

The family\u2019s attorney, Justin Shapiro, said the resort lacked proper security.<\/p>\n

<\/p>\n

\u201cThere was no supervision, no access control,\u201d Shapiro said. \u201cAnyone could have followed guests into that pool area from the beach [or] from the lobby\u201d.<\/p>\n

<\/p>\n

The lawsuit, filed by Shapiro on behalf of his clients, targets Radisson Resort Miami Beach\u2019s owners, operators, managers, and Diaz.<\/p>\n

\u201cWe have no indication that [the resort] had visible presence of security anywhere on that hotel\u2019s grounds, which is grossly inadequate,\u201d Shapiro said, adding that such a lack of security is \u201chighly unusual in Miami Beach.\u201d<\/p>\n

<\/p>\n

The parents said the incident has caused their daughter \u201clife-changing trauma.\u201d<\/p>\n

<\/p>\n

\u201cOur daughter is not the same anymore,\u201d the father said. \u201cShe is scared of things that she was not scared of before. She comes to our bedroom and sleeps now in our bedroom often.\u201d The father declined to provide his name to protect his daughter\u2019s privacy.<\/p>\n

<\/p>\n

The girl\u2019s mother added, \u201cWe just want to make sure this never, ever happens to any other child.\u201d<\/p>\n

<\/p>\n

CBS News Miami called and messaged the owners of the resort, but did not get a response.<\/p>\n

<\/p>\n

Diaz remains in jail without bond. Last month, his public defender filed a motion asking for a speedy trial, claiming the statutory period for securing one ended in April.<\/p>\n
