Standing before the jury, prosecutor Laura Adams declared George Pino was rushing to make his daughter\u2019s birthday celebration, which led him to crash his boat into a steel channel marker in Biscayne Bay, killing a 17-year-old girl.<\/p>\n

\u201cThis isn\u2019t blowing a stop sign,\u201d Adams told the jury during closing arguments Monday morning in Pino\u2019s trial. \u201cThis is blowing into the stop sign while on the wrong sign of the road when you\u2019ve been drinking.\u201d<\/p>\n

<\/p>\n

But for defense attorney Howard Srebnick, the crash was a tragic accident \u2014 and does not amount to a crime. In his closing statements, he told the jurors Pino may have been distracted and inattentive, but was not reckless or purposeful in the way he operated the boat before slamming into the channel marker.<\/p>\n

<\/p>\n

\u201cHe may have committed human error\u2026 but that does not make him a criminal,\u201d Srebnick said.<\/p>\n

<\/p>\n

Adams and Srebnick presented their final arguments before the six-person jury who will determine whether Pino, a 54-year-old Doral real estate broker, should be convicted of manslaughter and vessel homicide, two felony charges stemming from the crash. If convicted, Pino could face up to 15 years in a state prison and a $10,000 fine.<\/p>\n

<\/p>\n

Miami-Dade Circuit Court Judge Marisa Tinkler Mendez sent the jury to deliberate at 4:55 p.m.<\/p>\n

<\/p>\n

Luciana \u201cLucy\u201d Fernandez, 17, was killed and Katerina \u201cKaty\u201d Puig, now 21, was left with life-altering physical and neurological disabilities. Both were students at Our Lady of Lourdes Academy.<\/p>\n

<\/p>\n

The crash happened around 6 p.m. on Sept. 4, 2022, the Sunday night of Labor Day weekend, a busy time on the waterways. Pino was taking his wife, Cecilia, their daughter Cecilia and 11 of her friends back to the Ocean Reef Club in Key Largo after an outing off Elliott Key to celebrate his daughter\u2019s upcoming 18th birthday. They were planning to go dinner that night at the club with the girls.<\/p>\n

Pino, Adams told the jurors, decided to speed through the Cutter Bank channel, a busy channel that a maritime expert testified is akin to Interstate 95. Pino, focused on returning to Ocean Reef for his daughter\u2019s birthday dinner, operated his 29-foot Robalo on the wrong side of the channel, ultimately ramming the boat into the steel marker, Adams said. The boat capsized and the 14 passengers were hurtled into the bay.<\/p>\n

<\/p>\n

The crash was not an accident, Adams said, because Pino violated several navigational rules \u2014 and piloted the boat without thinking about the well-being of his wife, daughter and the 11 girls on the boat.<\/p>\n

<\/p>\n

\u201cYou can see that this defendant is a man who abdicated all responsibility that a captain of a ship owes all of his passengers,\u201d the prosecutor said.<\/p>\n

<\/p>\n

Adams urged the jury to find Pino guilty, saying the crash only occurred because Pino was reckless and criminally negligent when he was at the helm of the boat.<\/p>\n

<\/p>\n

\u201cNo one and nothing is responsible for the death of Lucy Fernandez except for the man sitting right there,\u201d Adams said. \u201cHe is the reason that she is gone.\u201d<\/p>\n

<\/p>\n

Asking the jury to find Pino not guilty, Srebnick said Pino may have simply lost track of the channel marker and turned out of the channel too soon, believing that he had already passed Marker 15.<\/p>\n

<\/p>\n

\u201cHe did not intend to hit the marker,\u201d Srebnick said. \u201cHe intended on taking those girls back to Ocean Reef.\u201d<\/p>\n

<\/p>\n

As Srebnick concluded his address to the jury, Pino began to tear up and take deep breaths. On the first day of the trial, during Srebnick\u2019s opening argument, Pino sobbed in front of the jury, leading the judge to pause proceedings.<\/p>\n

<\/p>\n

Lies \u2014 or false memories?<\/h2>\n

<\/p>\n

Looking at the jurors, Adams pointed out how Pino has repeated the claim he had swerved his vessel to the right to avoid the wake of another boat. No witness, including the passengers on Pino\u2019s 29-foot Robalo or in other boats behind him in the channel, saw what Adams has called the \u201cphantom boat.\u201d<\/p>\n

<\/p>\n

The lies, Adams said, were persistent. He lied to police, to his lawyer and to the court system, the prosecutor added.<\/p>\n

<\/p>\n

\u201cHe knew this was not just an accident,\u201d Adams \u201cThat\u2019s why he lied…\u201d<\/p>\n

<\/p>\n

When lead investigator Lt. William Thompson asked Pino about the crash, he blurted about another boat approaching him and included it in a written statement, hoping to blame someone else, Adams said. He and his wife Cecilia Pino repeated the statement under penalty of perjury in a court filing in a civil suit brought by the Puig family.<\/p>\n

<\/p>\n

\u201cHe lied, over and over and over again, about what happened. Why? To shift the blame away from himself and in avoidance of accountability.\u201d<\/p>\n

<\/p>\n

The statement about the other boat, Srebnick said, stemmed from false memories linked to a traumatic brain injury Pino sustained in the crash. After the impact, Pino fell on his face, chipping his teeth, and then hit the back of his head.<\/p>\n

<\/p>\n

Srebnick pointed out the testimony of Dr. Diana Barratt, a neurologist who examined Pino in February and determined he had a traumatic brain injury that may have caused him to falsely remember what happened before the crash. Srebnick called Pino\u2019s account of the other boat a \u201cconfabulated memory.\u201d \u201cIt\u2019s the only memory of the event he has,\u201d Srebnick said.<\/p>\n

<\/p>\n

The defense paid Barratt nearly $30,000 for her testimony and review of the case.<\/p>\n

<\/p>\n

Highlighting how Pino wasn\u2019t truthful about how the crash happened, Adams told jurors Pino was not likely honest when he said he drank only \u201ctwo beers\u201d on the day of the crash. Jurors are not aware that Pino refused to voluntarily submit to a blood alcohol test and that law enforcement failed to obtain a warrant for his blood sample the night of the crash.<\/p>\n

In the Florida Fish and Wildlife Conservation Commission\u2019s final report on the crash, Thompson states Pino declined to voluntarily submit his blood because his attorney wasn\u2019t present. But, Thompson\u2019s body camera footage shows Pino actually said no because he had \u2018\u2018two beers.\u201d<\/p>\n

<\/p>\n

While Pino was not charged with boating under the influence, the alcohol consumed during the outing was a prominent feature of the trial. Adams even referred to the time between when Pino accelerated his boat and the impact with the channel marker as \u201ca stupor.\u201d<\/p>\n

<\/p>\n

Adams emphasized that Pino\u2019s wife testified that Pino packed the drinks on the boat. The day after the crash, the boat was found to contain 61 empty and partially empty booze bottles and cans, after FWC officers pulled the boat from the bay. Pino\u2019s attorneys have said the empty bottles and cans came from boats tied up at the sandbar with them.<\/p>\n

<\/p>\n

Standing before the jury, Srebnick also criticized Adams\u2019 focus on alcohol, saying Pino is not charged with alcohol-related crimes. Several witnesses, including police officers and good Samaritans, testified that Pino did not appear impaired when they encountered him.<\/p>\n

<\/p>\n

Adams pointed out the four girls who testified in the trial admitted they consumed alcohol during that day, despite being under the legal drinking age of 21. Camila Alvarez, one of the teens on the boat, testified that she drank 10 hard lemonade seltzers. She was 17 at the time.<\/p>\n

<\/p>\n

Pino allowed alcohol to flow freely to the teen girls, the prosecutor said, because he wanted to be the \u201ccool dad.\u201d<\/p>\n

<\/p>\n

\u201cHow irresponsible,\u201d Adams said. \u201c…With a boat full of buzzed teenagers, if not drunk teenagers, this man decides to set course for that channel marker.\u201d<\/p>\n

<\/p>\n

\u2018Lightning fast\u2019<\/h2>\n

<\/p>\n

The prosecutor replayed camera footage that captured a FWC boat traveling around the same speed as Pino\u2019s at the time of the crash. The re-enactment videos were meant to show Pino had an unobstructed path on the waterway during the nine seconds before he slammed into Channel Marker 15, the last marker before getting to the docks at Ocean Reef.<\/p>\n

<\/p>\n

Lt. Paul Alber, a boat crash expert, testified that in the nine seconds leading up to the crash, Pino traveled the length of two football fields while going 47 mph, which Adams called \u201clightning fast\u201d on the water.<\/p>\n

<\/p>\n

Adams reminded jurors of how Alber testified the number of people on the Robalo \u2014 14 people \u2014 added an extra 1,000 pounds to the vessel. In order to reach the speed Pino was going with the amount of weight on the boat, Pino was going full throttle, Alber said.<\/p>\n

<\/p>\n

Adams likened the conditions on the boat to having a bunch of teenagers \u2014 with no seatbelts or airbags \u2014 in the back of a pick-up truck and zipping down an unpaved road.<\/p>\n

<\/p>\n

Srebnick countered that the Robalo is built to handle the speed Pino was going when he smashed into the marker \u2014 and the vessel is rated to have higher horsepower engines to make it go faster. Pino, the attorney argued, was traveling in a \u201csteady course\u201d at speeds the Robalo can handle in an area with no posted speed limits.<\/p>\n

<\/p>\n

\u201cHe wasn\u2019t drag racing. He wasn\u2019t doing donuts in the water. He was not\u2026 trying to be the cool dad,\u201d Srebnick said.<\/p>\n

<\/p>\n

The girls were sitting where the boat designed passengers to sit, and none were standing, Srebnick said. But the girls sitting on the bow may have obscured Pino\u2019s view of the piling because it was high tide when the crash happened.<\/p>\n

<\/p>\n

Channel Marker 15 sticks out of the water about 9 feet during high tide, which is 5 feet lower than the markers leading up to it, Srebnick said.<\/p>\n

<\/p>\n

A pivotal nine seconds<\/h2>\n

<\/p>\n

Adams stressed that Pino had nine seconds to avoid hitting the channel marker, and that evidence from the boat\u2019s GPS amounted to the navigational device being \u201ca witness.\u201d<\/p>\n

<\/p>\n

The prosecutor had jurors sit in silence after setting a timer on her phone for nine seconds.<\/p>\n

<\/p>\n

\u201cThat\u2019s a long time to not look at what\u2019s in front of you,\u201d Adams said. \u201c…This tells you he\u2019s guilty. No responsible operator of a vessel would ever do this.\u201d<\/p>\n

<\/p>\n

Adams said the defense\u2019s contention this was \u201cjust an accident\u201d and that Pino \u201cdidn\u2019t mean to\u201d crash is not a defense.<\/p>\n

<\/p>\n

\u201cBut just because you didn\u2019t mean to cause something terrible, if you were likely to cause something terrible…, the law says you\u2019re responsible,\u201d the prosecutor said. \u201cThere are consequences for your actions.\u201d<\/p>\n

<\/p>\n

During her closing argument, Adams also questioned Pino\u2019s wife\u2019s testimony that Pino was torn up by the crash, showing the jury social media posts shared months after the crash.<\/p>\n

<\/p>\n

In the photos, taken in December 2022, Pino was smiling alongside his family. (Cecilia Pino testified that one of the photos was taken on a trip to the Florida Panhandle and the other for their daughter\u2019s graduation.)<\/p>\n

<\/p>\n

\u201cTheir daughter is barely cold in her grave, and this is what was posted,\u201d Adams said, referencing Lucy Fernandez\u2019s parents, Andres and Melissa Fernandez.<\/p>\n
