Miami detention battle looms for Tate brothers linked to rape charges in England

Federal prosecutors in Miami said on Monday they will seek permanent detention of brothers Andrew and Tristan Tate, the infamous social media influencers wanted on rape charges in England, setting the stage for their bond hearing on Aug. 13 as they await extradition to the United Kingdom.

The brothers’ defense team will confront a nearly impossible task of winning their release from the Federal Detention Center in Miami, as Magistrate Judge Lauren Louis pointed out in court that their “detention is presumed” under the U.S. government’s extradition treaty with the United Kingdom. In court papers, prosecutors say the brothers should be detained until they are transferred to England because they are a flight risk and danger to the community.

The Tate brothers — known for promoting wealth, male dominance and misogyny as well as producing online adult porn videos — are accused in new arrest complaints of sexually assaulting women while choking and hitting them during encounters in England. Separately, the Tates still face previous charges alleging similar assaults in Romania but were released on bail.

Their defense lawyers told a throng of new media outside the federal courthouse in Miami on Monday that they should be treated in the United States just as they were in Romania, where the Tate brothers were granted bonds and allowed to travel.

“There is nothing to support what has been alleged [in England],” said defense lawyer Joseph McBride, decrying that the Tates were being held in solitary confinement in Miami because of the nature of the charges against them.

“The single, most important fact is that for three years, they have not fled” the jurisdiction of Romania, where they have had regular check-ins with the courts and law enforcement, said defense attorney Jackie Perczek. “It’s false” to make this claim in the United States.

“They are not going to flee,” she said.

The Tate brothers were arrested in Romania in 2023 and formally indicted on charges of human trafficking, rape and forming an organized criminal group, but their case has yet to proceed to trial. Two years later, a Romanian court significantly eased their travel restrictions, allowing the brothers to relocate to South Florida in February 2025.

This month, federal prosecutors filed the latest complaints in Miami on behalf of British authorities seeking the brothers’ extradition, leading to their arrests in mid-July. The United Kingdom must submit the extradition petition to the Department of State and Department of Justice by September. Assistant U.S. Attorney Alejandra Lopez said the request is expected to include more charges than those summarized in the brothers’ arrest complaints.

At the time of the alleged criminal conduct, both brothers ran a webcam operation in England and Romania where women, referred to as “cam girls,” performed sexual acts online for subscribers in exchange for money. One woman who worked in the brothers’ webcam business accused Andrew Tate of having intercourse with her without her consent while she was unconscious, according to one complaint.

The brothers were arrested on July 18 outside the James L. Knight Center in downtown Miami, with video showing them being handcuffed and carted off by federal agents in the latest chapter of their year-long stay in South Florida. The arrests occurred before a bare-knuckle boxing event at the Knight Center, 400 SE Second Ave., that Andrew was going to co-host.

The U.K.’s Crown Prosecution Service announced it would be pursuing new charges against the pair for rapes that allegedly occurred between July 2010 and August 2017.

Andrew, 39, is facing seven new counts of rape, three counts of arranging or facilitating trafficking for sexual exploitation, three counts of assault occasioning actual bodily harm and 19 additional charges for offenses relating to indecent images of a child and extreme pornography.

Tristan, 38, is facing one new count of sexual assault, two counts of rape and three counts of arranging or facilitating trafficking for sexual exploitation.

“These charging decisions followed receipt of a further file of evidence from Bedfordshire Police and bring the total number of alleged victims in this case to seven,” said Malcolm McHaffie, head of the Special Crime Division at the Crown Prosecution Service.

According to two arrest complaints unsealed in Miami federal court on Monday, British authorities accused the Tate brothers of sexually assaulting three women who they knew between 2012 and 2015.

One woman who was working as a “cam girl” in the brothers’ webcam business in early 2015 arranged to meet with Andrew Tate at her home in Bedford, England, according to his arrest complaint. While at her home, Tate is accused of putting his arm around her neck and placing her in a chokehold without her consent, penetrating her between bouts of unconsciousness over several hours.

The woman later provided messages that she exchanged with Andrew Tate on the former social media platform Twitter at the time of the alleged assaults. She communicated with him through his Twitter handle, @CobraTate, which is the handle that he still uses on the renamed platform X.

The complaint noted that Tate posted a photo of him and his brother, Tristan, in front of the U.S. Capitol in Washington last week on his X account.

In addition, British authorities also accused Andrew Tate of choking a second woman while he was having intercourse with her in Luton, England, in early July 2014, and on later occasions.

According to another arrest complaint, a third woman who had a long-term romantic relationship with Tristan Tate accused him of raping her at his apartment in Luton, England, on multiple occasions between April 2012 and December 2013. She told authorities that Tate regularly choked her to the point of unconsciousness while he penetrated her.

The woman said she made it clear to Tate that she did not consent to sex while unconscious, the complaint stated. She also told authorities that Tate struck her face and hit her with a belt on multiple occasions.

Each of the three women mentioned in the arrest complaints, filed by federal prosecutor Abbie Waxman, said they could identify the brothers from television and social media.

History of trouble in South Florida

The Tate brothers were arrested in Romania in 2023 in connection to an investigation of sexual exploitation, but they were allowed to leave the country last year.

Within hours, Andrew and Tristan flew on a private jet from Bucharest to Fort Lauderdale.

President Donald Trump and Gov. Ron DeSantis both said at the time they were in the dark on the brothers’ spontaneous destination decision.

DeSantis verbally rebuffed their arrival, saying, “Florida is not a place where you’re welcome with that type of conduct. … I don’t know how it came to this.”

In March of last year, Florida’s attorney general said his office opened a criminal investigation into the Tate brothers. Attorney General James Uthmeier announced on social media that he directed his office to work with law enforcement to conduct a preliminary inquiry into the Tate brothers.

“Based on a thorough review of the evidence, I’ve directed the Office of Statewide Prosecution to execute search warrants and issue subpoenas in the now-active criminal investigation into the Tate brothers,” Uthmeier said.

Last year, UltraViolet, a gender-justice organization, launched a campaign online and with posters hung through Miami’s Wynwood neighborhood marking Andrew as “Unwanted in Miami.”

They branded him a “sexual predator imported to the U.S. by President Donald Trump.”

In January, the brothers made headlines when a viral video showed the pair partying with influencers Nick Fuentes, Clavicular, Sneako, Myron Gaines and Justin Waller, blasting Kanye West’s controversial song “Heil Hitler,” inside Miami Beach’s Vendôme nightclub.

The Greater Miami Jewish Federation condemned the actions, three employees were fired, and the nightclub apologized for the “deeply offensive and unacceptable” actions.

Andrew Tate, a self-described misogynist with more than 10 million follows on X, has been banned from platforms like YouTube, TikTok and Instagram for violating hate-speech guidelines.

The Tate brothers, both former kickboxers, are known to be avid Trump supporters.
