Capt. Jose Maya, 40, has been “relieved of duty pending the criminal proceedings and the department’s internal administrative investigation,” Police Chief Juan Pinillos wrote in a statement on social media on Wednesday morning. “These allegations are deeply concerning and represent a serious breech of the public’s trust,” the statement reads.

Some time last year, a 23-year-old woman became suspicious of Maya after she left the bathroom after a shower wearing only a towel and found him lying down outside the bathroom, according to his arrest warrant. The woman told investigators that before leaving the bathroom “she noticed a small black object protruding beneath the bottom of the bathroom door but initially believed it to be an insect because she was not wearing her glasses or contact lenses,” the warrant reads.

Maya quickly stood up and told her he had been fixing a motion-activated night light near the bathroom, though the woman told investigators the explanation made no sense.

The small black object protruding underneath the door kept showing up and the woman told her mother about her suspicions. They came up with a plan to leave a cellphone recording in the hallway leading to the bathroom while she showered.

Deputies say the video shows Maya placing a recording device beneath the bathroom door as she showered. Detectives reviewed the footage and wrote that “[Maya] was observed lying flat on his stomach and using a cellular telephone and an unknown device to record the Victim from under the bathroom door,” according to the warrant.

The woman’s mother kicked Maya out of the house that they all shared, and he began to live with his mother in North Miami Beach. He is charged with video voyeurism

Maya appeared on Wednesday morning in bond court, where Judge Mindy Glazer ordered him to stay away from the woman and set his bond at $7,500.

Maya remained in jail Wednesday morning at the Turner Guilford Knight Correctional Center.
