The FIA stewards summoned Verstappen and representatives from Oracle Red Bull Racing after the incident, which occurred as the Dutchman exited Turn 7. After reviewing video footage, telemetry, team radio, timing, and other evidence, the stewards ruled that Verstappen had breached the yellow-flag regulations but decided against imposing a penalty.

The official verdict, issued at 11:38 p.m. local time on Friday, October 9, confirmed that “No penalty is applied.”

Why Max Verstappen Escaped a Penalty

According to the stewards’ report attached above, Verstappen was on a push lap when a single yellow flag was displayed as he exited Turn 7. Hamilton was ahead of the Red Bull driver and had been warned of his approach. The Ferrari driver subsequently slowed down and moved to the right to get off the racing line. The Dutchman overtook Hamilton before Turn 8, with both cars still inside the yellow-flag sector. He then abandoned his push lap.

However, the stewards found that the 29-year-old driver had responded to the yellow flag by lifting off the throttle and reducing his speed. Telemetry confirmed that he had lifted completely off the throttle within approximately 40 meters of entering the yellow-flag sector. Meanwhile, the Brit was braking and had slowed to less than 60 km/h when Verstappen passed him. Although the Red Bull star had also begun braking, the significant difference in their speeds contributed to the incident.

The stewards noted that Verstappen’s speed at the overtaking point was approximately 70 km/h lower than his speed on another push lap during the same session.

FIA Explains Decision on Verstappen

The stewards acknowledged that Verstappen had breached the regulations by overtaking Hamilton under yellow flags. However, they considered the circumstances before deciding against a penalty. The official verdict stated that the stewards were satisfied Verstappen had “reacted appropriately to the yellow flag by lifting off throttle and reducing speed.”

Verstappen also explained that avoiding the overtake would have required him to brake very heavily, which he believed could have created an unsafe situation. Ultimately, the stewards concluded that the overtake was an “unfortunate consequence of the significant closing speed differential” and determined that no penalty was warranted in the circumstances.

The decision gives Verstappen a crucial reprieve, but it does not erase the stewards’ finding that he breached the yellow-flag rules. Their reasoning hinged on his response to the warning, the substantial speed difference between the two cars, and the potential danger of braking more aggressively.

From a competitive standpoint, keeping a Sprint pole position is significant at a circuit where overtaking can be difficult. Verstappen now has the opportunity to convert his starting position into valuable points. The incident serves as a reminder that even when a driver escapes a penalty, the circumstances behind a stewards’ decision can remain open to scrutiny.
